Case dismissed for Alabama charged in 2017 slaying
BIRMINGHAM, Ala. (AP) — A case has been dismissed for an Alabama man accused of killing another man.
Al.com reports 36-year-old Anthony Lanard Carter II was charged with intentional murder in the 2017 death of 33-year-old DeAngelo Martezes Cain and was set to face trial this week. However, the Jefferson County District Attorney’s Office asked to effectively dismiss the case.
A judge granted a motion, saying the state has exhausted all options at its disposal in an attempt to locate and serve a necessary witness. The district attorney’s office says they’ll pursue the case again if the witness is found.
Cain was shot at a Sun Inn in October 2017. A witness told police Carter started an altercation and shot Cain. An attorney for Carter says they were well prepared to present a case of self-defense.
