Judge again rejects plea for woman accused in girl’s death
ALBUQUERQUE, N.M. (AP) — A New Mexico judge is refusing to reconsider a proposed plea agreement for a woman accused in the 2016 killing of a 10-year-old Albuquerque girl.
The Albuquerque Journal reports Judge Charles Brown during a short hearing Tuesday once again rejected an attempt by prosecutors to reach an agreement with Jessica Kelley.
Prosecutors earlier this month reached the agreement in exchange for Kelley’s testimony against others in the case. They’ve been trying to identify another suspect in Victoria Martens’ death.
Kelley attempted to plead guilty to child abuse recklessly permitted resulting in death but Brown rejected that deal, saying there was insufficient evidence that she was guilty of the crimes presented.
On Tuesday, Brown said he would not reconsider his earlier decision because prosecutors did not present any new information.
