Mill owner appeals water level order on Wiscasset lake
WISCASSET, Maine (AP) — A Maine mill owner is suing the state Department of Environmental Protection to overturn a water level order for a lake impounded by a dam.
The Kennebec Journal reports lawyers for AquaFortis Associates LLC and the DEP appeared in Lincoln County Superior Court Tuesday. AquFortis is appealing a water level order for Lake Clary in Wiscasset.
AquaFortis claims the water level should be vacated because the DEP has no authority over the dam. The company says the dam falls under the authority of the Mill Act.
The DEP says it gained jurisdiction over the dam when it received a petition to hold a hearing on the water level.
A previous appeal by AquaFortis went to mediation and was left unresolved in 2015.
