Ex-jail guard accused of assaulting, choking inmate

PORTSMOUTH, Va. (AP) — A former correctional officer accused of choking an inmate unconscious and injuring his arm last year has been indicted in Virginia.

News outlets report 59-year-old Dale Barnes was indicted Thursday. The former Hampton Roads Regional Jail correctional officer was charged with strangulation and malicious wounding.

The indictment follows a Justice Department report that concluded the jail’s treatment of inmates amounted to cruel and unusual punishment.

Inmate Skyler Peacock said Barnes attacked him Jan. 9 as he tried to get pills from a nurse. The 24-year-old inmate said Barnes lunged toward him at the top of some stairs and choked him until he was unconscious. He couldn’t move his arm when he came to. Barnes later resigned.

Defense attorney Nicholas Renninger says Peacock threatened to push his client down the stairs.
