Ex-officer says bank broke into his home without cause
ESTERO, Fla. (AP) — A retired police officer is suing a bank, saying its contractor broke into his southwest Florida house and falsely told people he was in foreclosure.
The News-Press of Fort Myers reports (http://newspr.es/1Bo2udL ) that former Chicago police officer Mike Tomasovich filed a lawsuit against Fifth Third Bank, which holds his mortgage.
According to the lawsuit, two men working for the bank’s contractor broke into the house in November and posted a sign saying it was found to be unsecure or vacant. He says they falsely told neighbors he is foreclosure. Tomasovich’s lawyer says even if the house had been in foreclosure, the bank would have needed a warrant to enter.
The lawsuit accuses the bank of trespassing, invasion of privacy and defamation.
The bank declined comment.
