Vehicular Homicide Charges Dropped Against Father
STROUDSBURG, Pa. (AP) _ The Monroe County district attorney dropped involuntary manslaughter and other charges Monday against a man whose 4-year-old daughter fell out of his moving car and was then struck and killed by a pickup truck.
Angelo Sergi, 38, of Tobyhanna was charged a year ago for not having his daughter Theresa seatbelted while he was driving along state Route 611 in Scotrun, Monroe County.
Theresa apparently rolled out of the car and into the path of the truck after Sergi made a u-turn.
But in a petition, District Attorney James P. Gregor said state law does not allow violations of child protection codes in the motor vehicle law to be admitted in vehicular homicide cases.
″Theresa Sergi died as a direct result of the injuries she sustained upon being struck by the pickup truck, not as a result of any of the alleged wrongful acts of the defendant,″ Gregor wrote.
