Trucking industry seeks to appeal suit over new state tolls
PROVIDENCE, R.I. (AP) — The national trucking industry is appealing a decision to toss out a lawsuit against Rhode Island’s truck tolling program.
The American Trucking Associations and its fellow related plaintiffs filed a notice of appeal Thursday. It comes about a week after a federal judge threw out the lawsuit, saying the challenge should be brought in the state court system.
Rhode Island Trucking Association President Chris Maxwell declined to elaborate on the filing, saying the case is heading to federal appellate court either way.
The industry claims the tolls are unconstitutional.
Rhode Island began collecting tolls on big trucks last year and plans a total of 14 gantries across the state.
