Prosecutors drop murder charges ahead of federal case

RUTLAND, Vt. (AP) — Vermont prosecutors have agreed to dismiss a murder charge against a man accused of fatally shooting his girlfriend while he faces federal gun charges.

The Rutland Herald reports second-degree murder charges would be re-filed against 56-year-old Frank Weir once the federal case is complete.

Weir pleaded not guilty Monday to felony charges of possessing a machine gun and possessing a gun with a destroyed serial number. The charges carry a prison sentence of up to 15 years.

Police say Weir called 911 in February 2017 to report his girlfriend, 57-year-old Donna Marzilli, was shot during a dispute.

A stipulated plea agreement shows he planned to plead guilty in exchange for a 20-year sentence with all but eight years suspended.

Authorities say the gun is not related to the murder case.
