Nutritional Products International Sues Brian Gould, Trulife Distribution

Nutritional Products International (NPI), a leading global marketer of health and wellness brands, recently filed a multi-count lawsuit against Brian Gould and entities he controls for theft of trade secrets, conspiracy, breach of fiduciary duty and unjust enrichment among other counts. According to the lawsuit, Brian Gould, while employed by NPI, systematically stole company files, trade secrets, prospective clients and company equipment and then diverted business to Nutra Sales International, LLC, Nutritional Sales and Consulting, Inc., Trulife Distribution, Inc. and BPG Consulting, Inc. The lawsuit seeks a temporary injunction and monetary damages, among other forms of relief, to prevent Brian Gould from operating businesses in competition with NPI.
Plaintiff Nutritional Products International, which is owned by the defendant’s father Mitch Gould, specializes in helping companies expand the sales of their new or existing products throughout the United States. For more than 30 years, the company’s proprietary distribution systems have helped hundreds of companies launch and sell products through online channels and with major retailers including Amazon, CVS, Target, Walgreens and Walmart.
According to the lawsuit, Brian Gould, who worked for NPI for 12 years, violated his fiduciary responsibilities as president multiple times when he disclosed confidential information and trade secrets, cloned NPI’s website, developed a competing Facebook page, recruited clients from NPI, stole client leads while attending a trade show on behalf of NPI, and stole a computer containing proprietary information. The lawsuit alleges he performed these acts while still working for NPI and using NPI corporate funds.
In similar lawsuits, NPI is suing Brian Gould’s new wife Rodica Lesan Gould as well as her parents Valentina Lesan and Anatolie Lesan for tortious interference and conspiracy, among other counts.
