Longmont Man Arrested on Suspicion of Attempted Murder is Charged with Assault
A Longmont man initially facing an attempted murder charge was formally charged with only assault at his second court hearing Tuesday afternoon in Boulder County Jail.
Justin Ruiz Harvey, 19, is charged with first-degree assault causing serious bodily injury, along with a sentence enhancer for committing a violent crime.
Harvey’s next court appearance will be Friday at Boulder County District Court for a hearing. He is currently being held at the jail on a $25,000 cash bond.
According to an arrest affidavit, Harvey on Friday repeatedly hit his brother in the head with a baseball bat . His brother was taken to Longmont United Hospital, where physicians told police he suffered a serious bodily injury.
When he was arrested Friday, Harvey told Longmont police he has a “toxic relationship” with his brother. According to the affidavit, Harvey told police he wanted his brother to stop talking and hit him in the head about five or six times.
