Sub Commander Guilty of Abusing Crew

November 1, 1995

HALIFAX, Canada (AP) _ A former submarine captain has been found guilty of five charges of abusing his crew.

Lt.-Cmdr. Dean Marsaw, 39, from nearby Dartmouth, was accused of insulting and screaming at his crew daily aboard HMCS Ojibwa between 1991 and 1993.

He was also charged with kicking one officer and physically abusing another who passed out from drinking during a Christmas party on the submarine.

Marsaw, an award-winning career officer, told his court-martial that he did not commit the offenses and said when he yelled at the men, it was justified and within military regulations.

A five-member military panel returned the guilty verdict Wednesday.

Marsaw can appeal to the Court Martial Appeal Court, and from there to the Supreme Court of Canada.

He was not immediately sentenced. The panel could sentence him to up to five years in prison or dishonorably discharge him.
