Gun, drug charges added to misconduct
A charge of sexual misconduct with a 14-year-old girl led to more charges of illegal gun and drug possession for a 52-year-old Fort Wayne man.
On Nov. 16, the victim and her mother, both from a nearby city, visited Richard Alan Myers, 52, of the 2200 block of Fairfield Avenue and his wife. That night, Myers’ wife and the girl’s mother left to pick up a relative from work, according to court documents.
While the two women were gone just over an hour, Myers stayed home with the girl and brought out a marijuana pipe and alcohol, court documents said.
The girl said she “did more,” meaning alcohol and marijuana, than she had ever done and went in and out of consciousness as a result of being high and intoxicated, court documents said. The girl said she had smoked “weed” with Myers before but this time was unusual, because he gave her “more hits” off the marijuana pipe than he gave himself.
During this time, the girl was on the couch and said she became aware Myers was performing sex acts on her. Nine days after the incident, the girl said she threw up. Concerned that she might be pregnant by Myers, the girl told her mother, court documents said.
After the girl’s mother contacted police, she disclosed that she knew her ex-husband had traded a sawed-off shotgun with Myers for a gaming console. The woman said she’d been to the house numerous times and saw various firearms, including shotguns and pistols.
As Myers is a convicted felon and not allowed to have a firearm, police got a search warrant and searched the home Dec. 20. They found two firearms hidden inside a cold air return, a sawed-off shotgun with no serial number and a semiautomatic, 12-gauge shotgun, court documents said.
Myers told police he did not touch the victim in a sexual manner and denied giving her alcohol or marijuana.
He said the girl “might have gotten some of the vodka mixed with orange Faygo pop that she had been drinking without his permission,” court records said. Myers said the women left him alone with the victim, but he’d argued with them that they should take her, court documents said.
Myers also told police he had swapped the firearm for a gaming console and that both guns were his.
A check of records found Myers is a court-ordered participant on the Allen County Sex Offender list and that he was convicted of escape and two charges of burglary in the past, court records said.
Myers was being held Tuesday at Allen County Jail in lieu of $20,750 bail. His charges include unlawful possession of a firearm by a serious violent felon and sexual misconduct with a minor with two misdemeanor charges of contributing to the delinquency of a minor and marijuana possession. He has a court hearing Friday.
