Man Shot, in Critical Condition After Being Mistaken for Killer

NEW YORK (AP) _ A witness to a killing was shot as he sat in the back seat of a police car by a relative of the victim, who mistook him for the killer, police say.

Scarvey McCargo, who police estimate to be in his early twenties, was shot in the chest early Monday and was listed in critical condition today at Brookdale Hospital, officials said.

Sgt. Maurice Howard, a police spokesman, said Anthony Woodbury, 23, of Brooklyn, mistook McCargo for the killer of his half brother, Calvin Elliot, 29.

Elliot was slain late Sunday in what appeared to be a drug-related shooting, Howard said.

Howard said McCargo had seen the shooting and was trying to help police find Elliot’s killer. He drove with detectives to a building and waited in the back seat as they went inside.

Woodbury then spotted McCargo and opened fire, Howard said. He fled after hitting McCargo once, but was quickly captured, the spokesman said.

Woodbury was being held on charges of attempted murder and criminal mischief, Howard said.

Police continued to investigate Elliot’s death, but no arrests had been made, Howard said.
