Mayville woman enters not guilty plea to OWI with children in car
JUNEAU — A 39-year-old Mayville woman pleaded not guilty Wednesday after being charged with driving while intoxicated with two children in her car.
Nicole L. Henry appeared before Dodge County Circuit Court Judge Steven Bauer for a third offense of felony operating a motor vehicle while intoxicated, with a child in the car. She could face up to two years in prison and a $4,000 fine if convicted.
According to the criminal complaint, a Mayville community service officer recognized Henry’s vehicle getting gas in the parking lot of Kwik Trip, 121 N. Main St., at 7 p.m. Sept. 28. The officer had heard an earlier complaint about her being intoxicated while she picked children up from school.
A Mayville officer pulled over Henry’s vehicle in the 500 block of North German Street. There were two children, 11 and 7, in the vehicle and an open bottle of alcohol fell on the pavement when Henry opened her car door.
Henry allegedly admitted that she started drinking at a friend’s house at noon and finished at 3:15 p.m. to pick up her children. She said she drank after that as well.
Henry has previously been convicted of OWI in 1996 and 2006.
Henry submitted to a breathalyzer test, which revealed a blood-alcohol level of .149, nearly twice the legal limit of .08.
