Sewer Line Installation Firm Sues Pittston Twp. For Pay, Damages
PITTSTON TWP. — The contractor completing a sewer line installation in Pittston Twp. sued the township’s sewer authority, saying it is owed almost $200,000 the authority refuses to pay, plus damages.
In its lawsuit against the Pittston Twp. Sewer Authority, Fehlinger Construction Group of Shavertown said the authority didn’t get permission from all the property owners it needed approval from in order for the company to complete the work.
Because of that, the company wasn’t able to access all the properties it needed to visit. The project remains incomplete and the authority hasn’t made a final payment.
“The authority is preventing Fehligner from completing its work while at the same time refusing to pay Fehlinger because Fehlinger has not completed its work,” read the complaint, filed Aug. 15 in Luzerne County Court of Common Pleas.
Failure to obtain permission from all the property owners involved meant the company had to jump around and skip over properties, which was expensive and inefficient.
Later in the project, the authority asked Fehlinger to speed up the pace of work, which cost the company more money the authority refused to pay.
Fehlinger said it is owed the balance of the contact, about $194,000, minus the value of work it has to complete. The company is also suing for $200,000 in damages.
