Judge rejects high-court review of death-penalty pretrial motion
Allen Superior Judge Fran Gull has rejected a request by lawyers for a man facing the death penalty to ask the Indiana Supreme Court to weigh whether she erred when she denied a motion to exclude execution as punishment for the alleged killings of four people.
The request would have postponed the trial of Marcus Dansby, 23, who is charged in the 2016 slayings.
Dansby’s defense attorneys had asked Gull to declare the state’s capital punishment law unconstitutional and throw out the death penalty because of his age -- 20 -- at the time of the killings. She denied both requests in February.
