Driver who killed pedestrian to get traffic ticket

The driver who struck and killed a pedestrian on Cerrillos Road in early December won’t face charges other than a traffic citation for being unlicensed, Santa Fe’s police chief said Wednesday.

Rafael Antonio Acuna-Flores, who police said was in his 20s, was identified in a search warrant affidavit as the driver of the 2007 Nissan that hit Margarito Paiz the evening of Dec. 1 as Paiz ran across Cerrillos Road outside of any designated crosswalk.

The affidavit said Paiz, who was wearing dark clothing, died at the scene.

Chief Andrew Padilla said Acuna-Flores, who investigators said was driving his mother’s car, will be issued a citation for lacking a driver’s license after the pedestrian was found mostly at fault for the incident.
