Judge denies dismissal motion in Northampton arson

April 18, 2013

NORTHAMPTON, Mass. (AP) — A judge has refused to dismiss charges against a Northampton man accused of setting a series of fires in the city in 2009 that resulted in two deaths.

The judge did, however, rule that indictments regarding seven fires set in 2007 cannot be pursued at Anthony Baye’s trial scheduled for next month.

Baye’s lawyers contend that there is little or no evidence that he set the earlier fires other than one expert’s opinion.

Authorities say the 28-year-old Baye set a series of fires early on Dec. 29, 2009. One claimed the lives of 81-year-old Paul Yeskie Sr. and 39-year-old Paul Yeskie Jr.

Baye faces multiple charges, including multiple counts of arson and two counts of murder.

The Republican (http://bit.ly/XSZoyi ) reports that Bay’s trial is scheduled to start May 6.
