Ex-police officer convicted in 1993 death seeks 3rd trial
BALTIMORE (AP) — A former Baltimore police officer convicted of first-degree murder in the 1993 death of a 22-year-old woman is seeking a new trial.
The Baltimore Sun reports a three-day hearing to determine if 61-year-old James Allen Kulbicki should get a third trial begins Monday in Baltimore County.
Kulbicki was convicted in 1993 in the death of Gina Nueslein, with whom he had an extramarital affair and fathered a child. He was retried in 1995.
Kulbicki’s lawyers have filed a petition for writ of actual innocence, saying expert testimony presented during his trial was later discredited, citing testimony regarding a forensic technique later found to be flawed and a state’s ballistics examiner who lied about his credentials.
Deputy State’s Attorney John Cox says the new evidence wouldn’t have changed the case’s outcome.
