Appeals court asks how abortion ruling affects Arkansas case
LITTLE ROCK, Ark. (AP) — A federal appeals court has asked how a decision upholding Indiana’s law requiring burial or cremation of fetal remains after an abortion affects an Arkansas case on abortion restrictions.
The 8th U.S. Circuit Court of Appeals on Thursday ordered attorneys for the state and abortion rights groups to file additional briefs on what impact, if any, this week’s U.S. Supreme Court ruling on Indiana’s law has on the Arkansas case. A federal judge in 2017 blocked an Arkansas fetal remains law and three other abortion restrictions, and the appeals court is considering the state’s challenge of that decision.
In the Indiana case, the U.S. Supreme Court also denied review of a lower court ruling that blocked a ban on abortion based on gender, race or disability.
