Judge dismisses 1 murder charge in dead baby case

WORCESTER, Mass. (AP) — A judge has dismissed one of the two murder charges a Massachusetts woman faced in connection with the discovery of three dead babies in her squalid home.

The judge, in agreeing with a defense motion, said Tuesday in the midst of Erika Murray’s trial that there was “no evidence here that that baby was alive, and therefore it could not have been a victim of a homicide.”

The 35-year-old Murray still faces one murder and several other charges in connection with the discovery of three babies’ bodies in the trash-strewn and vermin-infested Blackstone home in 2014.

Four living children also lived in the home, which has since been demolished.

Murray’s attorney has said his client is mentally ill.

The prosecution in the jury-waived trial in Worcester Superior Court rested Tuesday.
