Man Fails at Brain Tumor Defense

EAGLE POINT, Ore. (AP) _ A man who broke into his neighbor’s house and crawled into her bed, then blamed it on a brain tumor, has been sentenced to 2 1/2 years in prison.
Stephen Smith, 59, was convicted in January of burglary, stalking and attempted sexual abuse. During the trial, he testified the radio told him to go to the neighbor’s home last year.
Smith broke in after the woman’s husband left for work, prosecutors said. He went to her bedroom, undressed and crawled into bed with the 29-year-old woman, and told her: ``I want you,″ they said.
Realizing the man wasn’t her husband, the woman jumped out of bed screaming before Smith could touch her.
Judge Patricia Cain rejected Smith’s claim of ``mental defect.″
At his sentencing, Smith continued to blame the tumor, which was removed after his arrest. ``I’m sorry I had cancer, and I’m sorry I had delusions, and I’m sorry I was really bad,″ he said.
