Attorney general: Examiners did not break open records law

BISMARCK, N.D. (AP) — North Dakota Attorney General Wayne Stenehjem says medical examiners did not violate the state’s open records law by refusing to disclose death reports.

Stenehjem says his office received an inquiry based on autopsies performed by the North Dakota Forensic Examiner’s Office and the University of North Dakota medical school. He did not identify the case.

Stenehjem says the two offices contacted the law enforcement agencies looking into the case and were told that it was still active and the record should not be released.

The attorney general says a specific exception to the open records law allows protections for “active criminal intelligence and investigative information.”
