Judge refuses to declare missing bricklayer dead

RIO DE JANEIRO (AP) — A Brazilian judge is refusing to issue a death certificate for a bricklayer whose apparent disappearance in police custody prompted outrage across Rio de Janeiro.

The ruling means the family of Amarildo de Souza can’t yet get social security benefits.

Judge Luiz Henrique Marques said he couldn’t authorize a “presumption of death” certificate for the 42-year-old father of six because being in police custody “did not constitute a life threatening situation.” He said the certificate could only be issued once the search for the man is officially concluded.

Souza family attorney Joao Tancredo said Wednesday he will appeal the ruling.

De Souza has not been seen since police picked him up for questioning on June 14. Police say he left the station alive and on foot.
