Report: Whiten’s accuser picked up outside nightclub by teammate

MILWAUKEE (AP) _ Mark Whiten met the woman who accused him of sexual assault after she got into a truck outside a nightclub and rode with the New York Yankees outfielder to his hotel, it was reported.

The truck’s driver, a Milwaukee car salesman, said in the Sunday edition of the Milwaukee Journal Sentinel that he was giving Yankees third baseman Charlie Hayes a ride to the Pfister Hotel on July 18 when he drove up to several women outside the Metropolis nightclub.

``They were kind of cute,″ he told the newspaper on the condition that his name not be used. ``It was a beautiful night out. They were friendly. We were being friendly. They came to the truck, and the next thing I knew, this one Mark’s in trouble for jumped into the back seat.″

The automobile salesman’s account of the events matches the account Whiten gave to police and contradicts at least one account the woman gave, an unidentified police source told the Journal Sentinel.

Police told the newspaper that Whiten first met the 31-year-old woman in Hayes’ hotel room. The woman told police who responded to the hotel July 19 that she met a ballplayer at Festa Italiana and he drove her to the Pfister, the newspaper said.

Whiten was arrested on July 20 and released on $10,000 bond. Whiten told police he had sex with the woman but it was consensual.

The Milwaukee County District Attorney’s office is still sorting through the conflicting versions and have not issued any charges against Whiten.

Whiten’s lawyer, Stephen Glynn, said Sunday he expected a decision on charges today or Tuesday.

The automobile salesman told the newspaper that the woman grew more interested in Hayes after she found out he was a professional baseball player and saw his World Series ring.

``She was just fascinated by who he was and that he did play for the Yankees,″ he said. ``She was inquiring about tickets for the remaining series and whatnot.″

He said the woman appeared drunk.

``I could tell that by her speech and her eyes and actions,″ he said. ``She was loud.″

The man said he drove off after Hayes and the woman walked into the Pfister. He said he talked to Hayes about the woman the next day and was told she was ``acting really obnoxious and wild.″

``Mark for some reason knocked on the door and the girl ended up with Mark,″ the man told the Journal Sentinel. ``Charlie and Mark came out of the bathroom later that morning and the girl was on the phone with security.″

Police arriving at the hotel at 4 a.m. found the woman so disoriented they took her to the county’s Mental Health Complex.

``They were having difficulty substantiating what she had to say,″ Lt. Art Ketchman said. ``She had to be reinterviewed Monday.″
