Boswell magistrate reports: Dec. 13

The following preliminary hearings are scheduled before District Judge Susan Mankamyer in Boswell:

Drugs

Two men were lodged in the Somerset County Jail after police found drugs during a welfare check in Boswell Borough.

Jess White, 41, Main Street, Boswell, and Steven Deluke, 40, Ohio Street, Jeannette, have been charged with manufacture, delivery or possession with intent to manufacture or deliver; marijuana possession; and drug paraphernalia possession. White received an additional charge of intentional possession of a controlled substance by a person not registered, and Deluke received additional charges of criminal trespass and selling a controlled substance without a label.

According to two probable-cause affidavits, at about 6:18 p.m. Tuesday state police responded to White’s residence after being called to check on him by his daughter. During the check, police found two digital scales, a marijuana smoking device, marijuana, suspected methamphetamine, razor blades and lighters in plain view, according to the affidavit. White admitted one scale and the smoking device were his.

Neither would admit to the other items. The owner of the property had forbidden Deluke from entering on Nov. 27. The men were arraigned Tuesday by District Judge Douglas McCall Bell, of Meyersdale. White was sent to jail in lieu of a $10,000 bond and Deluke $1,000. Preliminary hearings are scheduled for 10 and 10:15 a.m., respectively, on Wednesday.
