Summit County to pay $3.5M to settle inmate death lawsuit

DENVER (AP) — Summit County has agreed to pay $3.5 million to the family of an inmate who died after suffering alcohol withdrawal in jail.

KMGH-TV reported Thursday that the lawsuit settlement will have to be approved by probate court because the man’s two children will receive the payout.

The lawsuit states that Zachary Moffitt had a blood alcohol content of .392 when admitted to a hospital for alcohol poisoning. Moffitt became agitated during hospitalization and walked out of the hospital. Police were called and Moffitt was taken to jail, still extremely drunk.

The suit states he was jailed for three days, exhibiting symptoms of alcohol withdrawal, but did not receive medical attention.

He suffered a cardiac arrest and died after four days on life support.

Sheriff Jamie FitzSimons said the jail has changed policies.
