Attorneys for Suspect in Fatal Boulder Shooting Ask to Be Taken Off Case

Attorneys for the suspect in a fatal downtown Boulder shooting have requested to be taken off the case, putting the scheduled October trial date in jeopardy.

Louis Sebastian, 33, is charged with first-degree murder in the May 2017 shooting of Christopher King, 49.

Sebastian has filed two motions to remove the public defender’s office from his case, but both motions were denied by separate judges.

But now, Sebastian’s attorneys have come out from their side and requested to be taken off the case, according to a motion filed on Tuesday.

“Counsel made repeated attempts to work to resolve the conflict with Mr. Sebastian,” defense attorney Jason Sharman wrote. “These repeated attempts have been unsuccessful. There is a complete breakdown in communications with Mr. Sebastian that cannot be overcome.”

Sharman wrote that after consulting with the state public defender’s office, “an irreconcilable conflict of interest exists and the public defender can no longer represent Mr. Sebastian.”

Sebastian at the moment is scheduled for a two-week trial beginning Oct. 15, but if a judge does appoint alternate defense counsel that date will almost certainly be pushed back. If it is, it would be the second time this trial has been pushed back since Sebastian pleaded not guilty in December 2017 .

The Boulder District Attorney’s Office has not issued any written response to the motion. Prosecutors have objected to further delays of the trial whenever Sebastian’s attorneys have requested them in the past.

A hearing to rule on the defense’s request for alternate defense counsel has not yet been set.

Sebastian is being held without bond at the Boulder County Jail as he awaits trial.

Police say Sebastian and King got into an argument at Bramble & Hare, 1970 13th St., on May 29, 2017. Witnesses said that the two then went outside and shortly after that gunshots rang out. King came back inside the restaurant, where Sebastian followed and fatally shot him.

Police said an employee of the restaurant was able to disarm Sebastian before police arrived to take him into custody.

The coroner’s office said King was shot four times — twice in the torso, once in the thigh and another time in the shoulder — and grazed by a bullet across his front groin area.

Sebastian has claimed self-defense.

The two men had met earlier in the day after different people invited them to the same croquet party in Boulder . They did not previously know each other, but witnesses at the party indicated the two might have been fighting over a woman at the party they both knew.
