North Dakota man charged with killing brother near Fort Peck

BILLINGS, Mont. (AP) — A 58-year-old North Dakota man is charged with killing his brother in northeastern Montana while officers were responding to the victim’s 911 call.

Valley County Sheriff Vernon Buerkle tells The Billings Gazette the victim asked officers to come to his house Thursday evening because he was concerned his brother was in the area.

Buerkle says the deputy responding to the residence about 2 miles (3 kilometers) south of Fort Peck encountered John Ersness, but had no probable cause to hold him.

When the deputy arrived at the residence, he found the 62-year-old man dead. His name and cause of death have not been released. An autopsy is planned.

Ersness was charged Friday with deliberate homicide. He did not enter a plea. He remained jailed Sunday on $500,000 bail.

Jailers declined to say if Ersness has an attorney.
