HARRISBURG, Pa. (AP) — Prosecutors say a man was justified in using deadly force on a suspect high on methamphetamines who broke into a home following the beating death of an elderly woman in a nearby residence last fall.

Police in Lower Paxton Township said 23-year-old Servando Luis Santos was "under the extreme influence of methamphetamine as well as cocaine" when he beat 79-year-old Patricia Hovan to death with a two-by-four piece of wood in September 2017.

Authorities said Santos then broke into a home a short distance away where a guest in the home shot and killed him as he approached wielding the weapon and ignoring repeated warnings

The Dauphin County district attorney's office said Monday that the shooter "without question ... acted with legal justification and proper restraint" in using deadly force.
