BROWNWOOD, Texas (AP) _ A new execution date was set for convicted child killer Ricky Nolen McGinn after DNA tests released Tuesday failed to clear him of raping and killing his 12-year-old stepdaughter.
State District Judge Stephen Ellis scheduled McGinn, convicted of murdering Stephanie Flanary, to die Sept. 27.
Tests by the Department of Pulic Safety, the FBI and a defense expert all point to McGinn as the source of evidence recovered from the victim.
When Gov. George Bush granted a 30-day reprieve June 1, McGinn had already eaten his last meal and was just 18 minutes away from a lethal injection for the 1993 crime.
