FARGO, N.D. (AP) — An 85-year-old Fargo man accused of shooting and killing his wife during an alleged double suicide pact has been charged with murder.

Court documents show that Louis Averson told authorities that he and 85-year-old Ila Averson agreed to kill themselves because of her poor health. He says they attempted carbon monoxide poisoning in their garage Friday night and sat in a vehicle for five hours. He says his wife knew he was going to shoot and then shoot himself. Louis Averson survived and remains in a Fargo hospital.

Police say they discovered a last will and testament for the couple inside their house and bill from a law that was completed earlier Friday.

Court documents do not list a lawyer for Louis Averson. He's scheduled to appear in court Tuesday.
