Judge reinstates medical marijuana provider’s license

BILLINGS, Mont. (AP) — A judge reinstated a Billings medical marijuana provider’s license after questioning whether the state health department violated the owner’s right to due process in revoking the license without giving the owner a chance to respond to the allegations.

District Judge Don Harris says he’ll likely issue a decision next week in the case of Montana Organic Medical Supply.

The Billings Gazette reports Montana Organic’s license was revoked after state inspectors alleged owner Steven Palmer failed to conduct lab tests before selling marijuana or marijuana products, improperly labeled products and purchased products from another provider.

The state argued Wednesday the business was shut down because regulators couldn’t determine if he was selling safe products.

During Wednesday’s hearing, Harris said he believed the immediate revocation infringed on Palmer’s right to due process.
