Former Pittston Area Band Leader Faces Child Sex Charges
PITTSTON — The former band director for Pittston Area School District faces sexual assault and child pornography charges alleging he engaged in sexual conduct as well as inappropriate games and dares with eight minors.
As he awaited trial on previously filed child pornography charges, Brendan J. Carter, 29, of 2438 state Route 92, Falls, was charged late Tuesday in eight new cases accusing him of misconduct dating to 2013.
The new charges include sexual assault, involuntary deviate sexual intercourse, possessing child pornography, corruption of minors, indecent exposure and criminal use of a communication facility.
According to the complaints, police found a nude photo of a boy taken when he was 14 or 15 years old in a “My Eyes Only Folder” on Carter’s iPhone. The boy told investigators he never sent Carter the photo and he doesn’t know how he got it.
A girl told police Carter, whom she described as very manipulative, had begun inquiring about the size of her boyfriend’s penis and asking to see nude photos of him, according to the charges. The girl told police she showed him a picture of her boyfriend’s genitals.
Carter then enlisted the girl to get nude images of another boy who was 15, the complaints allege. The girl succeeded in getting the boy to send a nude image via social media, at which point Carter grabbed her phone and showed her how to take a screen shot without the sender knowing, the complaints allege.
A third student told investigators Carter had exposed himself in front of male band members in the school’s music room.
The fourth complaint alleges Carter directed a student to slap another boy in the face with bodily fluid and had dared the boy to touch another boy’s penis.
At one point during the 2015-16 school year, the boy was given a cup of pudding that had been contaminated with bodily fluid from Carter and two other boys, the charges allege. Upon learning of the incident, the boy’s father had him tested for sexually transmitted diseases, according to the complaints.
The charges also allege Carter played games that required students to expose themselves and gave “inappropriate sexual dares” to band members.
Two other victims told police Carter played a game called “Are You?” and ask if the boys were circumcised. Carter would require the boys to expose themselves to verify their answers, the complaints allege.
The boys also said Carter would frequently discuss penis size and encouraged them to expose themselves for comparison purposes, according to the complaints.
The seventh victim told police Carter frequently issued dares while on the bus traveling to events. The dares included exposing their genitals and having other students touch them, police said.
Carter was previously charged in October with indecent assault, corruption of minors, and possessing child porn. Luzerne County detectives on Tuesday withdrew the charges in that case — which stemmed from some of the same conduct — as they filed the new charges.
Carter is now facing six counts of corruption of minors, four counts of indecent exposure, three counts of possessing child pornography, two counts each of indecent assault and criminal use of a communication facility, and one count each of sexual assault, sexual contact with a student and involuntary deviate sexual intercourse.
Magisterial District Judge Alexandra Kokura Kravitz arraigned Carter on the charges Tuesday evening and set his bail at a combined $875,000. A preliminary hearing was set for April 15.
