NEWPORT, N.H. (AP) — A former New Hampshire police officer accused of performing an illegal search and falsifying his report is asking to dismiss two of the six charges he faces.

The Valley News reports Ian Kibbe's lawyer requested dismissal of conspiracy to commit perjury and attempted perjury charges. They allege the former Claremont officer falsely claimed he found weapons "in plain view." Prosecutors say Kibbe unlawfully opened a suitcase and bag to uncover a baton and a handgun.

A judge found probable cause to charge a man with being a felon in possession of dangerous weapons. The charges were later dismissed.

Kibbe says the allegedly false statements he made weren't capable of affecting the probable cause hearing. Prosecutors disagree.

Kibbe, of Springfield, Vermont, also pleaded not guilty to unsworn falsification and obstructing government administration charges.
