Mayville man sentenced to 45 years in prison for sexual assault
JUNEAU — A 31-year-old Mayville man will serve 45 years in prison after being found guilty of molesting two young boys.
Benjamin Marx was found guilty in February of first-degree sexual assault of a child under 12 and child sexual exploitation.
Dodge County Circuit Court Judge Brian Pfitzinger sentenced him Monday to 45 years of initial confinement and 35 years of an extended sentence. He may have no contact with the victims nor anyone else under the age of 18 without prior agent approval. He may not possess any devices with the capability of taking photos or videos. He must pay court cost other fees. He must undergo a mental health assessment.
According to the criminal complaint, the mother of the children called 911 on Oct. 15, 2017, and told police that a man had admitted that he had molested her two small children.
The woman talked with police over the next few days and she told them that she and the man had separate Google accounts on the same computer. She said she went to the Google Photos page and the man’s account was logged in, revealing photos of sexual activity.
The woman confronted the man and asked who was in the photos. She said he admitted to molesting her two boys, both under age 10.
Police gained possession of his electronic equipment through warrants. Police talked to the man on Nov. 1, 2017, at a residence in Fond du Lac. Police had recovered erased images through the assistance of the Department of Justice Division of Criminal Investigation. The man told the police that he felt he needed an attorney, while being shown some of the photos that had been retrieved.
