Montana man sentenced for raping woman he found in garage
MISSOULA, Mont. (AP) — A Montana man who was convicted of rape has been sentenced to 40 years in prison with 20 years suspended.
The Missoulian reports 30-year-old Shane Pelletier was sentenced Friday after a jury in January found him guilty of sexual intercourse without consent.
The victim told police that she had blacked out from drinking and woke up in an unfamiliar Missoula apartment while be raped in July 2017.
Pelletier claimed that he was trying to help the woman after finding her in a parking garage. He claimed she gave consent for sex in an encounter he “believed would blossom into a romantic relationship.”
A clinical forensic psychologist testified that a combination of schizophrenia symptoms and intoxication likely affected Pelletier’s judgment.
Pelletier will be required to undergo sexual offender treatment in prison.
