Prosecutor Seeks To Stop Defendant’s Wedding
PATERSON, N.J. (AP) _ A prosecutor says he wants to stop the wedding of a man facing manslaughter charges and his pregnant girlfriend who is the state’s key witness in the case.
Passaic County Assistant Prosecutor John Cosmi, who filed a motion seeking a temporary restraining order, said Saturday must explain to a judge on Wednesday why defendant Robert Kassner, 20, should not be allowed to marry Diana Smolenski, 21, until the conclusion of the criminal trial.
Kassner is charged with death by auto and manslaughter in connection with an Oct. 28 two-car accident in which a 15-year-old girl was killed.
Miss Smolenski, who would not have to testify against Kassner if they were married, was the only passenger in his car and Cosmi considers her a key witness. No trial date has been set.
