Christmas tree lot owner killed by pizza delivery car

STOUGHTON, Mass. (AP) — A pizza delivery driver has pleaded not guilty after allegedly striking and killing the owner of a Christmas tree business with his car.

Michael Burns was ordered held on $20,000 cash bail at his Stoughton District Court arraignment Monday.

The accident happened at about 8:30 p.m. on Dec. 11. Prosecutors say the 33-year old had just delivered a pizza when he struck 71-year old Joseph Brady near his Christmas tree lot.

Burns was charged with motor vehicle homicide while driving under the influence after he failed several sobriety tests.

Prosecutors said Burns denied drinking or using drugs and told police he was partially blind in his left eye. Burns’ lawyer noted Monday his client remained at the scene and cooperated with police.

He’s due back in court Feb. 3.
