Woman, man jailed on charges after having sex in the middle of a Terrytown street
SCOTTSBLUFF — A Northglenn, Colorado, woman will serve 90 days in jail after being caught having sex in a public place.
Court documents say Danielle East, 41, was sentenced to 90 days in jail, with credit for three days served, on a charge of public indecency, a Class II misdemeanor, Monday. She was also fined $500 on the charge and $250 on a second charge of theft by receiving stolen property, a Class II misdemeanor.
A 46-year-old Scottsbluff man, San Juan Hernandez also faces charges of driving under the influence (blood alcohol content over .15), a Class I misdemeanor; driving under suspension, a Class III misdemeanor; public indecency, a Class II misdemeanor; and theft by receiving stolen property, a Class II misdemeanor, in the same incident. He is being held on a $25,000 bond and is next scheduled to appear in court on Oct. 31.
According to affidavits filed in Scotts Bluff County Court, Scottsbluff Police officers had received a complaint at about 6 p.m. on Friday, Aug. 17, of a man and a woman “having a sexual relationship,” while parked in the middle of a roadway and being easily visible by the public. The officer located the vehicle stopped in the middle of the roadway on Woodley Park Road.
An arriving officer found the man, sitting in the driver’s seat, performing a sexual act on the woman. The woman had no clothing on and her shirt was pulled up past her breasts, exposing herself to the public.
The officer making contact with the occupants described the man as apparently under the influence of alcohol and drugs and that he appeared to be dazed and confused. The officer said he could smell the odor of alcoholic beverages, had bloodshot and glassy eyes and his speech was slurred. The officer said he observed two bottles of vodka, one of which was open, and one of the bottles had an anti-theft device still on the cap, indicating it had been stolen. Both the man and the woman blamed the other for stealing the alcohol.
An officer performed field sobriety maneuvers on the male, who was allegedly unable to provide a sufficient breath sample and would not comply with field sobriety tests. In the affidavit, officers accuse the man of balling his fists at a woman officer and threatening to strike another officer. Police arrested the man, who was identified as San Juan Hernandez, alias Jonny or Johnny Hernandez. A search of records found his driver’s license to be revoked.
Police arrested the woman after questioning her and she allegedly said she would refuse to go to court, provided inconsistent statements about where she lived and said she would leave the state to go to Colorado.
