Conviction removed for man exonerated of separate crime
BALTIMORE (AP) — An exonerated Baltimore man has had a separate conviction in a related case removed despite a prosecutor’s protest.
The Baltimore Sun reports Demetrius Smith’s conviction in a 2008 shooting was removed Thursday when a judge called for probation before judgment.
Smith was convicted in a murder-for-hire slaying 2010 and served five years in prison before federal authorities determined he was wrongfully convicted in 2013. A key witness said in a sworn statement she misidentified Smith under pressure from police.
Smith’s previous attempts to change his conviction were blocked by Assistant State’s Attorney Richard Gibson. Gibson says the conviction should remain.
Judge Barry Williams says the conviction was cleared in the interest of justice.
