Mitchell man sentenced in sexual assault case
A Mitchell man has been sentenced to 3½ years imprisonment in a case accusing him of sexually assaulting a child.
Joseph Anaya, 34, had been set for sentencing in August on charges of third-degree sexual assault of a child, a Class IIIA felony, and obstructing a police officer, a Class I misdemeanor, when he failed to appear and warrants were sought for his arrest. He was eventually taken into custody in Colorado in January.
Anaya was sentenced on Feb. 1 to 3½ years imprisonment and 18 months post release supervision in the sexual assault case.
Charges in the initial case stemmed from an investigation that began when Gering Police had been contacted on Jan. 16, 2018, regarding a report of a possible sexual assault. During an interview with police, a 9-year-old girl disclosed that Anaya had touched her sexually during a visit and had also previously walked in on her in the shower and other acts.
With good time, Anaya will only serve half of his sentence, less than two years.
Charges in other cases against Anaya, including the cases involving failing to appear for sentencing and charges in other cases of driving under suspension, possession of a controlled substance and possession of drug paraphernalia, were dismissed earlier this month.
