Attorney says police were unjustified in shooting his client
FLOWOOD, Miss. (AP) — An attorney says police were unjustified in shooting his client in a supermarket parking lot in suburban Jackson.
Lawyer Dow Yoder tells WLBT-TV that Flowood police shot Kenara McDavid four times in the chest on Thursday night. He remained hospitalized in intensive care on Friday, breathing through a tube.
Flowood Police Chief Richie McCluskey said officers were called to arrest McDavid but says McDavid got into his car and tried to run over the police officer.
“Our officer shot into the car, fearing for his life while attempting to get out of harm’s way as the suspect continued through the parking lot,” McCluskey said. McDavid eventually wrecked in a ditch.
At the time of the shooting, Yoder said police were trying to arrest McDavid for attempting to illegally obtain prescribed medication.
McCluskey said the Mississippi Bureau of Investigation is handing the case, as is standard for a police shooting. The officer has not been identified.
Yoder said McDavid wants a court hearing as soon as possible on any charges.
“At this time, I am unaware of any evidence which may justify the use of deadly force during an attempted custodial police detention, since Mr. McDavid was not under arrest when he was repeatedly shot at close range,” Yoder said. He said he’s trying to obtain video recordings of the shooting.
