Broomfield Woman Sentenced in Fraud Case Asks for Reconsideration
A woman sentenced to Adams County Community Corrections for a fraud-related crime is asking to have her sentence that she violated her terms of placement reconsidered.
A revocation hearing was held Thursday morning at the Broomfield Combined Courts for Carol Klimmer, 73. In May she pleaded guilty to making an untrue statement in connection with the “offer, sale or purchase of any security, directly or indirectly,” essentially a case involving alleged elder abuse financial fraud.
Klimmer, who was initially charged with two counts of felony theft, including one from an at-risk victim, was sentenced to six years in community corrections.
According to court documents, one instance of theft occurred between Feb. 11, 2014, and Dec. 8, 2016, and included Klimmer knowingly taking $500 or more from an at-risk person while she was acting in a position of trust.
The second was in August 2016 when she was charged with theft of $100,000 to $1 million.
She is currently in police custody, but had entered the Time to Change Community Corrections Program on June 8.
The Henderson facility claimed that Klimmer “has been terminated from the program due to technical violations,” in a filing dated Sept. 25, but did not detail what those violations were.
Public defender Jessica Meza told Judge Michael Goodbee that Klimmer would like to exercise her right to administrative review of termination of community corrections.
The court made copies of a letter written by Klimmer to be sent to several parties, including one to the halfway house where she stayed. Community corrections also will be notified. Klimmer’s daughter will help her with sending letters and making follow-up phone calls, Meza said.
Goodbee set a future appearance to hear the issue for 8:30 a.m. Oct. 25.
One of the victims of the fraud was in the courtroom for Thursday’s proceeding, but victim’s names are redacted from court documents to protect their identity.
