Conviction, sentence upheld in 2013 beating death
MONTGOMERY, Ala. (AP) — The Alabama Court of Criminal Appeals has upheld the capital murder conviction and life-without-parole sentence in a 2013 Sumter County beating death.
Alabama Attorney General Steve Marshall on Thursday announced the court’s decision in the case of 25-year-old Damon Lake.
Al.com reports that Lake was convicted last year in the April 6, 2013, slaying of Terrell Brown.
Brown was beaten with a metal pipe during a robbery when Lake was 19.
Brown claimed that he had diminished capacity as though he were under the age of 18. Therefore, he argued, he should have been in the same protected class as juveniles covered by the U.S. Supreme Court ruling prohibiting mandatory sentences of life without parole for defendants under 18.
Marshall said the appeals court rejected the argument.
