Capital murder suspect mistakenly released from Texas prison

WACO, Texas (AP) — Authorities have apprehended a 61-year-old man who was released from prison after serving a term for arson when he was supposed to have been transferred to Central Texas on a capital murder charge in the 2006 death of a woman.

The Waco Tribune-Herald reports that Gerald Wayne Brown was free for two months before authorities discovered the mistake and found him Thursday in Waco.

Brown was sent to prison in 1993 on the arson conviction and paroled in 2004. He violated his parole and was returned to prison in 2011.

He was released on parole again in October, but instead should have been transferred to McLennan County where he was indicted last year on a count of capital murder in the arson death of Gloria Viera.

Online jail records don’t list an attorney for Brown.
