2nd Condemned Brother Executed
HUNTSVILLE, Texas (AP) _ A construction worker condemned for killing a jewelry store clerk in 1989 was executed by injection Thursday night, five years after his brother was executed for his role in the same crime.
Jose Gutierrez, 39, was the third condemned murderer put to death in Texas in as many days.
Gutierrez smiled in his final moments, sang two verses of the hymn ``Holy, Holy, Holy,″ and looked at his mother, who watched through a window from outside the death chamber. His parents, a brother and a sister sang along with him.
Gutierrez and his brother, Jessie, were convicted of fatally shooting Dorothy McNew, a clerk at the Texas Coin Exchange in College Station the morning of Sept. 5, 1989.
The brothers entered the store shortly before 10 a.m. and browsed about 15 minutes before Jose Gutierrez pulled out a handgun and shot Ms. McNew in the back of the head, according to store employees and customers who testified.
Testimony showed the wounded woman remained conscious, moaning and asking for help as the brothers cleaned out jewel cases and ripped telephone wires from the wall. She died the next day.
