The following preliminary hearing is scheduled before District Judge Ken Johnson in Somerset:
Cena Marie Matthis, 32, Water Works Road, Garrett, was charged Saturday with retail theft on Oct. 8. State police were dispatched to the Giant Eagle along North Center Avenue in Somerset Township after an employee reported that video caught a female concealing items in a shopping cart and leaving the store without paying for them. The items totaled $275.87. Police were called to the store on Dec. 14 when the woman returned. The woman was identified as Matthis. A preliminary hearing is scheduled for 10:55 a.m. Jan. 8.

Driving under the influence
• Robert J. Wargo, 46, Palmer Street, Fairhope, was charged Dec. 13 with driving under the influence on Oct. 29. State police were dispatched to a one-vehicle crash on Fairhope Road in Fairhope Township and observed several open cans of beer and blood on the driver’s seat. Wargo’s blood alcohol level was 0.28 percent. A hearing is scheduled for 2:30 p.m. Jan. 10.
• Elias Montgomery Penny, 23, Wills Church Road, Berlin, was charged Dec. 13 with driving under the influence on Dec. 8. State police were dispatched to a one-vehicle crash into a residence along Wills Church Road in Brothersvalley Township. Police found the vehicle against the residence. Penny’s blood alcohol level was 0.14 percent. A hearing is scheduled for 3 p.m. Jan. 10.
Matthew Christopher Torres, 26, North 4th Street, Philadelphia, was charged Dec. 13 with possession of a controlled substance, possession of a small amount of marijuana for personal use, possession of drug paraphernalia and driving under the influence on Nov. 25. State police were dispatched to assist a disabled motorist on the Pennsylvania Turnpike. Torres said he was traveling to Pittsburgh to see a rap artist and then said he just wanted to go for a ride. Police found marijuana and a grinder in the vehicle and a pill bottle prescribed to Sofia Martinez in the console. He refused a blood alcohol test. A hearing is scheduled for 3 p.m. Jan. 24.
